AADE Circular E.2004/2026 Sets Out E-Invoicing Penalties
Circular E.2004/2026 of 13 February 2026 states that an invoice issued by hand or by another technical means such as an ERP, rather than through a licensed electronic issuance provider or the AADE timologio application, counts as an invoice that was never issued. The only exception is a loss of connection caused by a power cut or an internet outage, in which case transmission follows paragraph 6 of Article 5 of Decision A.1138/2020. The fines of paragraphs 5 and 6 of Article 57 of Law 5104/2024 then apply: 50% of the tax the missing document would have carried for transactions carrying VAT, with floors of EUR 250 or EUR 500 per audit and higher rates on repeat, and EUR 500 or EUR 1,000 per audit for transactions outside VAT.
