Law 88/2026 makes RO e-Factura optional for CNP-identified individuals
Law No. 88/2026, approving Government Emergency Ordinance No. 128/2024, was published in Monitorul Oficial No. 459 of 29 May 2026 and applies from 1 June 2026. It removes the mandatory RO e-Factura obligation for suppliers identified by personal identification number, for natural persons farming under the special regime of article 315^1 of the Fiscal Code, and for foreign cultural institutes working in Romania under intergovernmental agreements. Those categories may still use the system by enrolling in the optional RO e-Factura register, and suppliers already entered in the mandatory or optional register may ask to be taken out with effect from the first day of the following month, per Law No. 88/2026 .

ANAF Order No. 378 of 22 March 2026, published in Monitorul Oficial No. 250 of 31 March 2026, amended Order 3789/2024 on the procedure for the mandatory RO e-Factura register. GEO 89/2025 moves RO e-Factura transmission to five working days
Government Emergency Ordinance No. 89/2025 was published in Monitorul Oficial No. 1203 of 24 December 2025. From 1 January 2026 the deadline for transmitting invoices to RO e-Factura runs to five working days from the invoice date rather than five calendar days, calculated under Regulation (EEC, Euratom) No. 1182/71. The same date brought supplies to taxable persons not established in Romania but registered here for VAT into scope, excluding fiscal receipts that qualify as simplified invoices and intra-Community supplies where the buyer gives another Member State VAT number. Suppliers identified by personal identification number were required to enrol in the mandatory RO e-Factura register from 15 January 2026, per GEO 89/2025 .
